You must be at least eighteen (18) years of age to create an account or use the Services. During registration, you are required to provide your date of birth, and we verify that you meet the minimum age requirement before your account is activated. By registering, you represent and warrant that: (a) you are at least 18 years old; (b) the date of birth you provide is accurate; (c) you have the legal capacity to enter into these Terms; and (d) your use of the Services does not violate any applicable law or regulation. We reserve the right to request additional proof of age at any time and to suspend or terminate any account that we reasonably believe belongs to a person under 18.

To access certain features you must register for an account by providing a valid email address and creating a password. You agree to: (a) provide accurate and complete information; (b) keep your login credentials confidential; (c) notify us immediately at [email protected] of any unauthorized access to or use of your account; and (d) accept responsibility for all activity that occurs under your account. You may not share, sell, or transfer your account to another person. We reserve the right to reclaim display names (hashtags) that are inactive, misleading, or infringe on third-party rights.

"User Content" means any photos, captions, poll responses, replies, profile information, support messages, and other material you submit through the Services. You are solely responsible for your User Content and the consequences of posting it. You agree not to submit content that:

We reserve the right—but are not obligated—to review, moderate, refuse, or remove any User Content at our sole discretion, with or without notice.

LiveFromWisco has a zero-tolerance policy for objectionable content and abusive users. We will remove any content that violates these Terms and permanently terminate the accounts of users who engage in abusive behavior, harassment, or repeated violations of our Community Guidelines.

All photo submissions are subject to review by our moderation team before they appear in the public feed. Content may be classified by content rating (e.g., "SFW" or "Spicy") at our discretion. We may reject, remove, or reclassify content that we determine violates these Terms or our community guidelines. Repeated violations may result in upload restrictions, account suspension, or permanent ban. Moderation decisions are made at our sole discretion and are final.

You retain all ownership rights in your User Content. By submitting User Content to the Services, you grant Live From Wisco a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, host, store, reproduce, modify (for formatting or display purposes), display, and distribute your User Content solely in connection with operating and providing the Services. This license continues until you delete the content or your account, except that copies may persist in backups for a reasonable period.

The Services, including all software, design, text, graphics, logos, and trademarks, are the exclusive property of Live From Wisco or its licensors and are protected by U.S. and international intellectual-property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

We respect intellectual-property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Services infringes your copyright, please send a written notice to [email protected] containing: (a) a description of the copyrighted work; (b) identification of the infringing material and its location on the Services; (c) your contact information; (d) a statement that you have a good-faith belief the use is unauthorized; (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized agent; and (f) your physical or electronic signature. We will respond to valid notices in accordance with applicable law and may remove or disable access to the allegedly infringing content. Repeat infringers may have their accounts terminated.

Certain features of the Services are available only through a paid VIP subscription. Payments are processed by Stripe, a third-party payment processor. By subscribing, you agree to Stripe's terms of service and authorize recurring charges at the interval you select (monthly, yearly, or lifetime). Subscription fees are non-refundable except as required by applicable law. We reserve the right to change subscription pricing upon thirty (30) days' notice; price changes will take effect at the start of your next billing cycle. You may cancel your subscription at any time through your account settings; access to VIP features will continue until the end of the current billing period.

The Services include technology that may detect when a screenshot is taken while viewing content. Screenshot events are logged and may be reported to the content owner and our moderation team. This feature is designed to protect the rights of content creators. Excessive or abusive screenshotting may result in account warnings, restrictions, or termination at our discretion. By using the Services, you acknowledge and consent to this detection.

You may report content or users that you believe violate these Terms by using the in-app reporting feature. Reports are reviewed by our moderation team and may result in content removal, account warnings, or account termination. We take reports seriously but cannot guarantee specific outcomes. Filing false or malicious reports may itself result in account action.

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. By using the Services, you consent to the data practices described in our Privacy Policy.

We may suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice, including but not limited to: violation of these Terms; fraudulent, abusive, or illegal activity; extended inactivity; or failure to meet eligibility requirements. You may delete your account at any time by contacting [email protected]. Upon termination: (a) your license to use the Services immediately ceases; (b) we may delete your User Content; and (c) provisions of these Terms that by their nature should survive (including Sections 5, 12, 13, 14, 15, and 16) will remain in effect.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY USER CONTENT OR THIRD-PARTY PRODUCTS OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIVE FROM WISCO, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY ON THE SERVICES; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA; OR (D) ANY OTHER MATTER RELATED TO THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50.00) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Live From Wisco and its officers, directors, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict-of-law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be resolved through good-faith informal negotiation by contacting us at [email protected]. If the dispute is not resolved within thirty (30) days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Washington County, Wisconsin, or remotely at the claimant's election. Each party shall bear its own costs; AAA filing fees shall be governed by AAA rules.

YOU AND LIVE FROM WISCO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction in Washington County, Wisconsin, to prevent the actual or threatened infringement or misappropriation of intellectual-property rights.

We may revise these Terms at any time by posting an updated version on the Services. Material changes will be communicated via email or in-app notice at least fourteen (14) days before they take effect. Your continued use of the Services after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Services and delete your account.
